In Sweden, there is a special Estate Agents’ Act, governing the estate agent’s profession, both as to the right to pursue agency activities and as to the estate agents’ obligations, responsibility and rights.
A person working as an estate agent has to be registered with a special government authority and the prerequisites for the registration are evident from the Estate Agents’ Act. Today, a two-year university education is required, i.a. containing law, economics and building technology. By way of his thorough education, the estate agent assumes responsibility for, and handles the entire transfer including drawing-up of transfer agreements.
The Swedish estate agent
is intended to be an impartial counsellor both to the seller and the buyer, except in one respect, i.e. that the estate agent has a special obligation to his employer with regard to the price issue. If the estate agent is employed by the seller, the estate agent’s primary obligation is consequently to try to get the best price for his employer, but otherwise, with regard to information about the estate, advice or information, the estate agent also has a damages-sanctioned responsibility towards the buyer. When it comes to drawing-up of transfer agreements, the estate agent shall, in equal parts, watch the interests of both buyer and seller and formulate the transfer agreement in a way enabling both parties to understand its meaning.
